James Otis Argues Against Writs of Assistance
James Otis, a lawyer representing Boston merchants, challenges the constitutionality of writs of assistance—warrants that allow customs officers to search for illegal goods based only upon suspicion of their presence—in court as "the worst instrument of arbitrary power." John Adams would later recall that "American independence was then and there born."
